UCC fire provisions by reference

The Review and Advisory Council’s letter in Regulation #12-125 names the 2021 IFC, adopted by reference only and without modification. The UCC therefore has no free-standing statewide fire code. Labor & Industry’s UCC pages give Jan 1, 2026, as the effective date.

Exceptions

  • Applies only to the extent other adopted ICC codes reference it; the UCC does not adopt the IFC as a stand-alone fire prevention code
  • Philadelphia’s Title 4 code likewise applies the 2021 IFC only where the IBC and IEBC reference it

How Pennsylvania adopts the IFC

  • Agency rule
  • The legislature sets the update schedule
  • A recent law changed the process

Under the Construction Code Act (Act 45 of 1999, restructured by Acts 1 of 2011 and 36 of 2017), the Review and Advisory Council starts reviewing each new ICC triennial edition 21 months after publication, holds at least three public hearings, and adopts updated sections by majority vote when unopposed and by a two-thirds majority of its members for adopting or modifying other sections. L&I must then promulgate final-omitted regulations adopting the Council’s decisions without change within nine months of the Council’s report, with an effective date 33 months after review began; IRRC approved the 2021 package on Oct 16, 2025, it was published Nov 8, 2025, and took effect Jan 1, 2026. No bill or legislative vote is part of this process.

Cycle. Triennial by design (Council review starts 21 months after each ICC edition and rules take effect 33 months after review begins), but adoption has been irregular: 2015 I-Codes effective Oct 1, 2018, 2018 I-Codes effective Feb 14, 2022 (per L&I’s home page), 2021 I-Codes effective Jan 1, 2026.
