How Pennsylvania adopts the IBC
Under the Construction Code Act (Act 45 of 1999, restructured by Acts 1 of 2011 and 36 of 2017), the Review and Advisory Council starts reviewing each new ICC triennial edition 21 months after publication, holds at least three public hearings, and adopts updated sections by majority vote when unopposed and by a two-thirds majority of its members for adopting or modifying other sections. L&I must then promulgate final-omitted regulations adopting the Council’s decisions without change within nine months of the Council’s report, with an effective date 33 months after review began; IRRC approved the 2021 package on Oct 16, 2025, it was published Nov 8, 2025, and took effect Jan 1, 2026. No bill or legislative vote is part of this process.
Cycle. Triennial by design (Council review starts 21 months after each ICC edition and rules take effect 33 months after review begins), but adoption has been irregular: 2015 I-Codes effective Oct 1, 2018, 2018 I-Codes effective Feb 14, 2022 (per L&I’s home page), 2021 I-Codes effective Jan 1, 2026.

- Court rulingPa. Builders Ass’n v. Dep’t of Labor, 284 A.3d 1287 (Commonwealth Court, 2022)
The statute’s compiler’s note records that Section 304(a)(3), the accessibility-update mandate, was declared unconstitutional, and L&I reports the 2021 accessibility updates are permanently enjoined, so the 2018 accessibility provisions still apply.
- Other actionRegulation #12-115: UCC accessibility update from the 2021 I-Codes (final-omitted)
L&I published the accessibility provisions of the 2021 I-Codes as a final-omitted rule, which the Commonwealth Court later barred from enforcement.
