The Commission reviewed the 2024 IECC. No direct statement of the 9th Edition commercial energy base (IECC or ASHRAE 90.1) was found. Under s. 553.73(7)(e) as amended by ch. 2023-211, the Commission can delay the energy provisions of an updated code. Based on a summary of the enrolled text, the delay is up to 3 months when compliance software is not approved at least 3 months ahead. The effective date is the Commission workplan target. The final rule hearing was still TBD on Oct 17, 2026, and s. 553.73(7)(e) requires at least 6 months after publication of the updated code.
How Florida adopts the IECC commercial
The Florida Building Commission adopts each triennial edition, including the Energy Conservation volume, by rule under Chapter 120 (s. 553.73(1)(a), (7)(a)), reviewing updates based on the IECC while maintaining the efficiencies of the Florida Energy Efficiency Code, and the rule takes effect no sooner than 6 months after publication (s. 553.73(7)(e)). Ch. 2023-211 lets the Commission delay the energy provisions’ effective date when compliance software is not approved in time. General Chapter 120 oversight applies (JAPC review is built into the workplan; ratification under s. 120.541(3) only if estimated costs exceed the thresholds), and local governments may add more-stringent technical amendments effective 30 days after the Commission receives them (s. 553.73(4)).
Cycle. Triennial by statute (s. 553.73(7)(a)); 8th Edition effective Dec 31, 2023, 9th Edition targeted for Dec 31, 2026; interim amendments and errata between cycles.
