Adopted with the 2025 rules but suspended by court order (stipulation filed Nov 12, 2025, in Mulhern Gas Co. v. Mosley); DOS said on Jul 2, 2026, it remains suspended. Statutory dates are Dec 31, 2025 (new buildings up to seven stories, except commercial or industrial buildings over 100,000 sq ft) and after Dec 31, 2028 (all other new buildings).
How New York adopts the IECC commercial
The Code Council adopts the State Energy Conservation Construction Code (19 NYCRR Part 1240) by rule under Energy Law Article 11, from time to time as it deems appropriate. Energy Law 11-103(2) requires the code to meet or exceed the then most recently published IECC (residential) and ASHRAE 90.1 (commercial) and, since a 2022 amendment, to use best efforts to exceed their savings; Energy Law 11-104(6)-(7), in a section amended by Part RR of Chapter 56 of the Laws of 2023, requires the code to prohibit fossil-fuel equipment in new buildings on fixed dates, but the implementing rules are suspended by court order. The 2025 energy rule followed the Uniform Code timeline: adopted Jul 25, 2025, amended Dec 5, 2025, effective Dec 31, 2025.
Cycle. Irregular; no statutory schedule, though the code must meet or exceed the latest IECC or ASHRAE 90.1 published when it is adopted. Previous update effective May 12, 2020, current Dec 31, 2025.
Laws, rulings, and other actions
- Court rulingSecond Circuit decision that the State all-electric law and NYC Local Law 154 are not preempted by EPCA (Ass’n of Contracting Plumbers of the City of New York v. City of New York, 180 F.4th 434; DOS links a Mulhern Gas v. Mosley decision)
Removes the legal obstacle behind the stay; DOS said on Jul 2, 2026, the provisions stay suspended pending updates, and a law-firm article reports the stay ends Oct 28, 2026, unless the plaintiffs seek Supreme Court review.
- LegislationPart RR of Chapter 56 of the Laws of 2023 (All-Electric Buildings Act; Energy Law 11-104(6)-(7))
Requires the Code Council to make the energy code and Uniform Code prohibit fossil-fuel equipment and building systems in new buildings up to seven stories (except commercial or industrial buildings over 100,000 sq ft) from Dec 31, 2025, and in all other new buildings after Dec 31, 2028, with exemptions.
Enacted 2023; statutory prohibition dates Dec 31, 2025, and Dec 31, 2028; implementing rules suspended by court order since Nov 12, 2025, still suspended per DOS on Jul 2, 2026; no later statute changing the dates was found
