How New Jersey adopts the NEC
The DCA Commissioner amends N.J.A.C. 5:23 by rule under the Uniform Construction Code Act (N.J.S.A. 52:27D-119 et seq.), after the Code Advisory Board and its subcode committees review the model code. The NEC is updated through the Electrical Subcode in N.J.A.C. 5:23-3.16, proposed in the NJ Register, with a public comment period, then adopted. The statute (N.J.S.A. 52:27D-123 as amended 1996) limits adoption of new model-code publications to no more than once every three years, but no legislative approval step was found.
Cycle. Roughly every three to four years following the model code cycle (2020 NEC effective Sep 6, 2022, 2023 NEC effective Aug 17, 2026); the statute caps adoption frequency at once per three years
Laws, rulings, and other actions
- LegislationP.L. 1996, c.53 (Assembly Committee Substitute for A1708 and A1782)
Amended the Uniform Construction Code Act (N.J.S.A. 52:27D-123) so subcodes may be adopted individually and adoption of new model-code publications cannot occur more often than once every three years except in imminent peril.
Enacted Jun 28, 1996, effective first day of third month after enactment
